Terms of Service

These terms are a draft under legal review. They describe our intended terms and will be replaced by the final version before they take effect.

1. Who we are and what this covers

These terms are between you and [LEGAL ENTITY NAME] (“ChatWatch”, “we”) and govern your use of chatwatch.net and the ChatWatch service. By creating an account you agree to them and to our Privacy Policy.

2. Eligibility

You must be at least 18 years old and able to enter a binding contract.

3. Your account

Keep your password confidential. You are responsible for everything done through your account. Tell us immediately at [email protected] if you think it has been compromised.

4. What the service does

ChatWatch records the online / offline status that WhatsApp makes visible to your linked account for the contacts you choose to track, and presents it as history and analytics. It does not access message content, calls, or media. Availability of status information depends on WhatsApp and on each contact’s own privacy settings; we cannot guarantee that any particular contact’s status will be visible or recorded.

5. Acceptable use

You agree to use ChatWatch only where you have a lawful basis to do so. You must not use it to:

  • monitor anyone in a way that is unlawful where you or they are located, including in breach of anti-stalking, harassment, or surveillance laws;
  • monitor a person who has asked you to stop;
  • harass, intimidate, threaten, or control anyone;
  • monitor a minor unless you are their parent or legal guardian;
  • interfere with WhatsApp or circumvent its security or terms in ways other than using ChatWatch as provided;
  • resell, scrape, or automate access to the service; or
  • share your account with anyone else.

You are solely responsible for how you use the information ChatWatch shows you. We may suspend or terminate accounts we reasonably believe are in breach. [COUNSEL TO REVIEW THIS SECTION CAREFULLY.]

6. Subscriptions, trials, and billing

  • Paid plans renew automatically at the end of each billing period until you cancel. Payments are processed by Stripe or PayPal on the web, and by Apple or Google if you subscribed inside a mobile app.
  • Accounts whose WhatsApp number belongs to the United States, Canada, the United Kingdom, the European Union, Australia or New Zealand get a free preview: one tracked contact for 24 hours, with no payment method required. When it ends, tracking pauses until you start a subscription. Other countries start directly with the trial below.
  • The free trial lasts 3 days and requires a valid payment method up front. It is available once per account: if you have subscribed before, you are not eligible for another trial. The trial converts to a paid subscription at the end of the 3 days unless cancelled first.
  • You can cancel at any time from your subscription settings; cancellation takes effect at the end of the current period.
  • No refunds. Payments are not refunded, in whole or in part, including for unused time after you cancel. The free preview and the free trial exist so that you can test the service before paying, and you can cancel at any time so that you are never billed for a period you did not want. If you are a consumer in the EU, the UK, or another place that gives you a statutory right to withdraw from an online purchase, that right is not affected; by starting a subscription you ask us to begin the service immediately and acknowledge that, once it has begun, the withdrawal right no longer applies to the period already supplied. 7. Intellectual property

ChatWatch, its name, logo, software, and interface are our property. You get a personal, non-transferable licence to use the service under these terms and nothing more. WhatsApp is a trademark of its owner; ChatWatch is not affiliated with or endorsed by WhatsApp or Meta.

8. Disclaimers

The service is provided “as is”. Activity data reflects what WhatsApp exposed at the time it was recorded and may be incomplete or delayed. Analytics such as chat probability are statistical estimates, not facts about what any person did. Do not rely on them for any decision with legal, financial, or personal consequences.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect or consequential loss, and our total liability to you is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law.

10. Termination

You can close your account at any time. We may suspend or close it for breach of these terms, for legal reasons, or if we discontinue the service, in which case we will refund any prepaid period we do not provide.

11. Changes

We may update these terms. We will post the new version here and, for material changes, email account holders before they take effect.

12. Governing law

These terms are governed by the laws of [JURISDICTION]. Consumers keep any mandatory protections of the country they live in.
